Rules and Regulations
THIS IS SCHEDULE “A” TO THE STANDARD FORM OF LEASE
Privacy and convenience are best achieved by people living together with some mutually agreed upon understanding. We ask that you and your neighbours consent to certain rules designed to help maintain community appearance and tranquility.
1. FINANCIAL OBLIGATIONS
a) All rental payments are due and payable on the first day of each month. The Tenant agrees to pay the rent by cheque, money order, debit or pre-authorized debit (PAD). Cheques may be made payable to the company indicated on the Standard Form of Lease. Please indicate your apartment number on the face of your cheque. WE DO NOT ACCEPT CASH. Should the Tenant wish to pay rent using a credit card, a three percent (3%) processing fee will be charged.
b) A late fee of $50 will be applied to the Tenant’s account if a balance is still outstanding by close of business on the second day each and every month.
c) For all NSF cheques there will be a charge of $50 applied to your account. All returned cheques are to be replaced immediately by certified cheque, money order or debit card.
d) A twenty (20) day eviction notice will be issued to Tenants who fail to fully settle their rental account by close of business on the second day of each month. A fee of $100 will be charged to the Tenant’s account for the issuance of an eviction notice.
e) It is acknowledged that if the Tenant takes possession of the premises prior to the commencement date of the Standard Form of Lease agreement, the Tenant shall pay a pro-rated rent for the period preceding the commencement date of the Standard Form of Lease agreement for the use and occupation of the premises, and all terms and conditions of the Standard Form of Lease and Schedule A shall apply from the possession of the premises.
2. LEASE TERMINATION/EVICTION
a) If on a periodic tenancy, as per Section 3(b) of the Standard Form of Lease, notice must be given in WRITING as noted on the Standard Form of Lease prior to your anticipated move-out date.
b) The apartment is to be fully cleaned and vacated by 12:00 NOON on the last day of the month indicated on your notice. Additional charges and any liquidated damages resulting from termination of the lease agreement prior to the full term must also be paid. Tenants remaining resident in the apartment after 12:00 NOON on the last day of said Standard Form of Lease will be charged an overholding charge of $50 per hour for every hour past noon.
c) The Tenant is directly responsible for leaving the suite in acceptable condition. Carpets must be professionally steamcleaned. Should the apartment not be considered acceptable for the next Tenant or if the Tenant fails to return the property of the Landlord, charges will be made accordingly as follows:
Parking card not returned $100

Carpet cleaning (one bedroom) $100
Carpet cleaning (two bedroom) $120
Carpet cleaning (three bedroom) $140
Clean-up of unacceptable suites $ 25 per hour
Plus all applicable taxes.
Damages resulting from negligence to structure and floor coverings will be calculated and charged back to the Tenant accordingly. Monies owing as a result of incomplete cleaning or damages will be deducted from the security/damage deposit.

d) In the event the Tenant vacates the premises for any reason, including early termination by the Landlord for breach of lease terms and conditions, the Tenant will be charged a re-rental fee of $200 plus the cost of advertising and will also be responsible for paying the rent until the end of the lease term, or until a suitable Tenant is found to occupy the premises.
e) Should the Tenant fail to move out on the notice to vacate date and/or the Landlord takes legal action to remove the Tenant, the Tenant shall be responsible for all of the Landlord’s reasonable costs incurred as well as the Landlord’s reasonable administration costs.
3. OCCUPANCY
a) Apartment __________ was painted, carpets shampooed and in ready condition for the Tenant when occupancy commenced on ___________________.
YES __________ NO __________. If NO, please indicate on the required move-in inspection forms.
b) Only the person(s) listed on the Standard Form of Lease may occupy the premises. No persons under the age of 21 are permitted to permanently reside on the premises unless their lease has been signed by an approved guarantor. The Tenant agrees to limit the number of residents to one more than the number of bedrooms unless otherwise agreed to in writing by the Landlord.
c) No pets are permitted without the written consent of the Landlord.
d) It shall be the responsibility of the Tenant to insure the Tenant’s property on the premises against damage or loss to such property occasioned by fire, theft and/or any other perils which cause damage or loss. The Tenant shall obtain and carry general comprehensive liability insurance against willful or neglect acts or omissions by the Tenant or persons for whom the Tenant is responsible. Students may be covered by their parent’s homeowners insurance and must provide the name, policy number and contact information of their insurance provider.
e) Parking is provided to the Tenant at their own risk. The Landlord is not responsible for any damages or theft to the Tenant’s vehicle(s) which parked on the property. The Tenant must obtain personal vehicle insurance to cover any such damages.
f) Keys are issued at the time of occupancy after completion of all paperwork related to the Standard Form of Lease and full payment of first month’s rent and security deposit. Keys not returned to Management upon termination of tenancy will result in a $75 charge per key not returned. The Tenant acknowledges that apartment access locks are master keyed to provide Management access for requested maintenance and emergencies.
g) A $100 charge will be applied to the Tenant’s account in the event Management is required to allow the Tenant to access the apartment as a result of the Tenant’s negligence.
h) Resident and visiting children must be supervised so that they will not present a disturbance or disciplinary problems for the other tenants or Management. Children or guests are not to play or loiter in the interior common areas (laundry room, hallways, entrances, exits and stairwells).
i) Damages and resulting costs associated with damage to the property or the property of other Tenants as a result of negligence on the part of the Tenant, their guests, visitors or for whom they are at law responsible for, will be the direct responsibility of the Tenant.
j) Should the Tenant fail to take possession of the premises at the commencement of the term of the Standard Form of Lease Agreement, or abandon the premises before the termination of the Lease Agreement, the Landlord may take possession without notice or demand and re-let the premises on such conditions as the Landlord may deem advisable, without prejudice to the Landlord’s right to recover rental payment which may be owing and without prejudice to any claim or claims for damages.
k) The apartments at Princess Place are heated by natural gas boilers. Each spring the boilers are shut down for the summer and are brought back on again in the fall. The actual date for the shut- down and start-up will vary each year depending on weather conditions. The Tenant acknowledges the Landlord is not required to provide heat in the units during this annual shut- down period.
4. APARTMENT FIXTURES & FURNITURE
a) Requests for maintenance and repairs may be made by telephoning the office of the Landlord between 9:00 a.m. and 5:00 p.m. Monday to Friday. Calls determined to be of an emergency nature will be handled immediately. No charge is made for repairs or adjustments unless necessitated by negligence or mistreatment by the Tenant. For emergency maintenance, please call 452-1971 immediately.
b) Each apartment is equipped at the time of occupancy with electric light bulbs. After move-in, the Tenant is responsible for their replacement.
c) No heavy objects, including waterbeds, aquariums or safes will be permitted on the premises without the written permission of the Management or without the requisite insurance. A copy of such insurance must be provided to the Management at their request.
d) No wiring for electrical lights, television or radio connections or otherwise are to be introduced, nor the position of any wiring altered, and the telephone shall be permitted only at the place provided.
e) Doors from hallways to apartments must be kept closed, and during Tenant absence, must be locked at all times.
f) No water shall be left running unless in actual use.
g) The Tenant is not permitted to use stickers or tape to affix pictures to the wall.
h) Locks must not be installed, changed or removed without the written permission of the Management.
i) In order to prevent moisture and mildew, the Tenant is not permitted to set box springs and/or mattresses directly on the floor or against the wall; air circulation requires at least 6” clearance.
j) The Tenant agrees not to dispose of anything in the flush that may cause the system to clog including condoms, sanitary napkins, diapers, etc. The Tenant will not install stickers or grips in the bottom of the tub.
k) The Tenant agrees not to utilize bass amplifiers or woofers on entertainment equipment. If your entertainment system is heard from outside your apartment, complaints may warrant an eviction.
5. REGULATIONS REGARDING FACILITIES
a) Please remove clothing from the machines promptly and do not use tints or dyes. Please report any malfunction of the machines to the Management Office and call Venda Wash directly if you have lost money in the machines. Please follow the operating instructions and clean out the lint filter with each use. The Landlord accepts no responsibility for damage to your clothing by the coin operated washer and dryers.
b) Tenants are not permitted to use or store gasoline, paint or other flammable materials on the property.
c) Please keep the premises clean by using the garbage chute located on each floor of the building (FHT) or the dumpsters located outside the building (PP) or as otherwise designated by the Management. It is imperative that all garbage is accordingly wrapped, contained or secured, and that boxes are broken down prior to disposal. Garbage must not be left in the halls or common areas at any time.
d) No Tenant, members of his/her family, guests or visitors shall make or permit loud or improper noise (e.g. play or operate a musical instrument, radio or television, stereo, machinery or other equipment) or do anything that would reasonably annoy, disturb or interfere with other tenants quiet enjoyment in other apartments in the building. The Tenant, his family, guests, visitors, servants, clerks or agents shall not consume or have in their possession to consume in any common area of the premises, alcoholic beverages or illegal substances.
e) Awnings, shades or other equipment will not permitted on the exterior of the building. Sheets, flags, foil or other like materials are not permitted to be hung or placed in front of windows. Balconies or patios are not to be used for hanging or drying clothes. Balconies are not to be used for the storage of materials that will significantly detract from the exterior presentation of the property, based solely on the opinion of the Management. If requested by the Management, the Tenant will promptly remove any/all distractions specified. All windows/doors must be tightly closed and locked when the Tenant is absent from the premises. Likewise, nothing shall be thrown or swept from balconies or patios thereby causing a disturbance or danger to other tenants.
f) Parking spaces are provided solely for privately licensed vehicles of the Tenant. Vehicles must be parked within designated lines and all “NO PARKING” zones must be observed at all times. Failure to observe may result in a fine and/or towing of the offending vehicle. Washing or repair of vehicles is not permitted within designated parking or no parking areas. Damages from defective vehicles, immobile/unlicensed vehicles i.e. those which leak gasoline or oil into the parking areas will be charged back to the Tenant at a rate established by the Management. There shall be no storage of R.V.’s, older vehicles, trailers, etc. in the parking area at any time without the written permission of the Management.
g) In line with the continuing program to maintain the appearance of the property, co-operation is requested in keeping land areas free of litter, shopping carts, bicycles and other equipment which might otherwise detract from the surroundings.
h) Tenant’s are not permitted to throw, sweep or place objects into the hallways or common areas. Cleanliness of all hallways and common areas must be maintained at all times.
i) The Tenant shall not display any signs, advertisements or notices on the premises, including the balcony or patio.
j) The Tenant will not be permitted to have a birdfeeder or otherwise attract birds or squirrels to balconies, patios or in or around the premises.
6. HEALTH & SAFETY
Although the Landlord cannot guarantee the security and safety of anyone, we strive to do everything we can to provide you with the means of taking responsibility for your own personal safety and security.
a) The emergency fire, police and ambulance number in Fredericton is 911.
b) Smoking is not permitted in the common areas of the building. The Tenant is not to dispose of cigarette butts or similar products off balconies, out the windows or on any of the common areas or grounds.
c) Propane barbeques and tanks are not permitted by law on the balconies or patios.
d) The Tenant is not permitted to have firearms or illegal drugs on the property.
e) Unattended candles are a leading cause of home fires and therefore the use of candles is not permitted on the property.
